Protecting your privacy is important to us. We therefore feel it is essential that we inform you of the way in which we collect, store, use and process any personal data and information you might share with us via this website (https://www.fertiplus-france.com) As a general rule, we will only collect your personal data via the contact form and when you are visiting the Site (see Cookies section).
The present Policy applies to “personal data and information” that we collect through this Site. “Personal data and information” is any data that could be used to identify you personally, either individually or in combination with any other information we might hold.
We strive to be as clear as possible. However, if you are not familiar with the terms “cookies”, “IP address”, “pixel tags” or “browsers”, for example, you should find out more about these terms beforehand.
What personal information and data do we collect?
Personal information includes any information that enables us to identify you.
We may ask you to provide us with your name, telephone number, e-mail address and/or location, as well as certain information concerning your company and your position or any other information that you might volunteer via our contact form.
This information may be stored in our administrative and contact databases, depending on our past and/or on-going dealings with you or any desire on your part to receive information from us regarding our company and our services. This enables us to manage our relationship with you efficiently and to improve our Site. Our databases are hosted by OVH in France.
In addition to the aforementioned personal data, the Site automatically records login information provided by the browser the visitor uses to access the Site (Internet Explorer, etc.). This information includes data concerning the visitor’s IP address, the pages of the Site they visited from this address and the last website the visitor viewed before this one. As European jurisdictions consider IP addresses to be personal information, we inform you that none of this browsing data is used by Fertiplus France for the purposes of directly or indirectly identifying any visitors using the Site. Browsing data is used anonymously to identify any potential Internet server-related problems, to administer the Site and to collect general demographic data in order to make the Site more useful and appealing to visitors. This data is only stored for as long as the Site is being viewed.
Cookies
A cookie is a small data file that websites install on a visitor’s hard drive when they visit a site. A cookie file contains information that can be used to recognise a visitor each time they return to the site. Data is encrypted for greater security.

Google reCAPTCHA
We use certain forms of the Google reCAPTCHA service on the Site in order to protect against the misuse of our web forms and spam. This service checks manual entries to prevent automated software (known as bots) from misusing the Site. In accordance with Article 6 of the GDPR, this helps protect our essentially legitimate interests in protecting our Site against misuse and in ensuring the optimal presentation of our online presence.
Google reCAPTCHA is developed by Google Ireland Limited, a company incorporated in Ireland and whose head office is located at Gordon House, Barrow Street, Dublin 4, Ireland (www.google.de). Insofar as information is transferred to and stored on Google servers in the United States, the American company Google LLC is certified under the EU-US Data Privacy Framework. Google reCAPTCHA uses a code integrated into the Site and known as JavaScript as part of the verification methods used to analyse your use of the Site, such as cookies. Information regarding your use of the Site that is collected automatically, including your IP address, is generally transmitted to and stored on a Google server in the United States. Google reCAPTCHA also evaluates other cookies stored in your browser by Google’s services.

How do we use the data we collect?
Generally speaking, we use the personal information that we collect via our site for the following purposes:

With whom do we share the data we collect?
We share personal information with our internal departments and, where necessary, with companies and organisations that provide services on our behalf, such as companies that provide us with support services (including data storage, web hosting and maintenance services – see the General Terms and Conditions of Use of our Site for details). These third party companies are contractually obliged to use the personal data we share with them for the sole purpose of providing services on our behalf and are contractually obliged to take commercially reasonable steps to protect the privacy and security of your personal data.
If you do not want us to share your personal data with these third parties, you can “withdraw your consent” at any time by sending us an e-mail via our Contact form or to data-privacy@desangosse.com.
We may share your personal data if we believe in good faith that this is appropriate for the purposes of complying with the law, a court order or a summons. We may also share your personal data to prevent or investigate potential or suspected criminal activity, such as fraud or identity theft, to enforce or apply our online Terms of Use or any other agreement, or to protect our own rights or property, or the rights, property or safety of our users or third parties.
Your consent
In using this Site you are agreeing to the practices outlined in this Policy (including the Cookie Policy which is available on this Site). If you do not agree to the terms of this Policy, please do not continue to browse this Site. As for your personal data, with the exception of browsing data, you make an informed decision to share this with us when you fill in the form provided on the Site.
You will be deemed to have given your consent once you tick the box indicating that you agree to the processing of your personal data. Without this acceptance, your form cannot be sent to our internal departments.
Direct marketing
The DE SANGOSSE Group may use your personal data collected via the Site to send you information about and offers on our products and services. Since such marketing activities are aimed exclusively at professionals, we are not obliged to obtain your prior consent before sending you any commercial proposals and/or information in the form of newsletters, for example. You will need to provide your full name, address and e-mail address in order for us to process your request. Once we have the necessary information we will remove you from our mailing lists (see paragraphs entitled “What are your rights?” and “What steps must we take?” of the present Policy). You will be systematically reminded of the procedures for exercising your right to object when you receive any commercial proposals and/or information from us in the form of newsletters, for example.
Children/adolescents and privacy
Our Site is not intended to be used by children (dependent minors), nor is it aimed at them. We do not knowingly collect information shared by – or regarding – minors without the consent of a parent or legal guardian.
If you are a minor, please do not share any personal information with us. If we become aware that a minor has shared with us through our Site information that would allow them to be personally identified, we will take reasonable steps to delete such information from our databases.
What are your rights?

You may exercise your right to object to or access your personal data at any time, as well as to have it corrected, deleted or restricted, by e-mailing us at data-privacy@desangosse.com.
What does this mean?
Information (Art. 13 and 14 of Regulation (EU) 2016/679): when data is collected, we must inform you of the purposes for which said data will be processed and of your rights. You will have been reminded of this before completing the form on the Site, as well as via this notice.
Right of access (Art. 15 of Regulation (EU) 2016/679): you have the right to obtain confirmation as to whether or not the data collected is being processed, and if so, access to this data, as well as to certain information such as that mentioned above.
Right of rectification (Art. 16 of Regulation (EU) 2016/679): you have the right to have any inaccurate data rectified and any incomplete data completed as soon as possible.
Right to erasure (Art 17. of Regulation(EU) 2016/679): you have the right to have such data erased as soon as possible in the event that you have withdrawn your consent to the processing, you object to it, the data is no longer required for the purposes for which it was being processed, it has been unlawfully processed, or it must be erased in order to comply with a legal obligation, except in certain specific cases which we will indicate to you where applicable. If we have made this data public, we will be obliged to inform the other data controllers who process the data that the data and any reproductions thereof must be deleted.
Right to restriction of processing (Art. 18 of Regulation (EU) 2016/679): you have the right to have the processing of your data restricted in the event that you have objected to it, you dispute the accuracy of the data, it has been unlawfully processed, or you need it for the purposes of establishing, exercising or defending a legal claim.
Right to portability (Art. 20 of Regulation(EU) 2016/679): where processing is based on consent, or on a contract, and is carried out by means of automated processes, you have the right to receive the data in a structured, commonly used, machine-readable and interoperable format and to share it with another data controller without us having the right to object.
Right to object (Art. 21 of Regulation (EU) 2016/679): you may object to being included in a file on legitimate grounds at any time. With regard to canvassing, and that of a commercial nature in particular, including any profiling linked to such canvassing, this right may be exercised without the need to provide any justification whatsoever.
Automated decision-making (Art. 22 of Regulation(EU) 2016/679): you have the right not to be subject to a decision based exclusively on automated processing, including profiling, which produces legal effects concerning or affecting you, except (i) where said decision is necessary for entering into or executing a contract, (ii) is legally authorised or (iii) is based on your consent.
What steps must we take if you decide to exercise one or more of your rights?
Should you decide to exercise any of the aforementioned rights, we will reply to you within one month of receiving your request. Given the number of requests we receive and their complexity, this deadline may be extended to two months, in which case you will be informed of the delay and the reasons for the postponement within one month of us receiving your request. You will need to provide your full name, address and e-mail address for each request in order for us to locate you in our records.

For the purposes of protecting your data, and in the event of reasonable doubt on our part as to your identity, we reserve the right to request any additional information we might consider necessary in order to confirm your identity before exercising any rights that you might wish to exercise.
We will not ask for any payment in return for exercising any of these rights. However, in the event of a manifestly unfounded or excessive request, we will be entitled to require that you pay the administrative costs corresponding to such requests or to refuse them.
If we do not respond, you will be informed of the reasons for said lack of response within one month of us receiving your request. You will then have the option of lodging an appeal with the Commission Nationale de l’Informatique et des Libertés (the French Data Protection Authority, CNIL) located at 3 Place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, and/or of lodging an appeal with the courts.
How long do we store personal data?
We periodically destroy personal data if there is no longer any reason to use or to share it in accordance with the terms of this Policy. Unless you specifically request otherwise, your data will be stored for one year if we do not have a direct commercial relationship with you and for three years in all other cases.
How do we protect personal data?
We take all appropriate precautions to protect the security and confidentiality of the personal data you share with us, notably to prevent it from being distorted, damaged or accessed by unauthorised third parties.
In this respect, we undertake not to access or use the data for any purposes other than those of which you will have been informed. We also implement, either directly or via our service providers, (a) identity and access checks via both an authentication system and a password policy, (b) user and administrator authentication processes, as well as measures to protect administration functions, (c) processes and mechanisms enabling all actions performed on the information system to be traced and reporting actions to be carried out in accordance with the regulations in force in the event of an incident that affects your data.

Fertiplus France is a French company based in Carbonne (31), France. We use Internet servers and store data in France and in any other country recognised by the European Commission as having an adequate level of protection where personal data is concerned. We may share your personal data with our service providers located in France or in other countries for the purposes outlined in the present Policy. Each country has its own privacy laws and requirements, with some offering less legal protection for your personal data than others. Please bear in mind, however, that wherever your personal data is collected, used, shared or stored, if it has been collected via this Site it will be protected by the terms of this Policy. In using this Site you are consenting to your personal data being collected, used and shared within France, to France, or to any other country in the world offering equivalent security guarantees.
Applicable law
The present Policy is governed by French law without regard to its conflict of law provisions.
